Sens.ai Terms of Service

PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING SENS.AI PRODUCTS OR SERVICES. These Terms, together with our Terms of Sale, set forth the legally binding terms and conditions for your use of Sens.ai Products and related services.

1. INTRODUCTION AND DEFINITIONS
These Terms apply to both Personal Members (individuals using Sens.ai Products for personal, non-commercial purposes) and Professional Members (authorized to use Sens.ai Products in approved commercial contexts, as described in Section 5). By using the Products or Services, you agree to these Terms. Products include the Sens.ai Headset, accessories, and any other hardware purchased from Sens.ai, an Authorized Reseller, or an Authorized Partner. Services include the Sens.ai App, Memberships, and related online or offline functionality. Memberships may be Personal or Professional.

2. ACCOUNT REQUIREMENTS
To access certain features, you must create an account and maintain accurate information. You are responsible for keeping your login credentials secure.

3. LICENSE AND PERMITTED USES
Sens.ai grants you a limited, non-exclusive, non-transferable license to use the Products and Services in accordance with these Terms. Personal Members: May use Products only for personal, non-commercial purposes. Professional Members: May use Products in approved commercial contexts, such as providing paid client sessions, provided their Professional Membership is active and in good standing.

4. PROHIBITED USES
You may not:

• Use Products for unauthorized commercial purposes without a Professional Membership.
• Modify, reverse engineer, or tamper with Products.
• Use Products in a manner that violates applicable laws.
  
  

5. MEMBERSHIP TERMS
Memberships are billed per the payment schedule agreed at purchase. Professional Memberships may have minimum contract terms, committed monthly billing amounts, and include a specified number of Sessions or Uses per month. Additional sessions may be billed at the then-current per-session rate. Annual Memberships will automatically renew on the renewal date unless cancelled in advance. Sens.ai will notify the Customer prior to the renewal charge, but additional permission will not be required for the renewal. Current Membership status can be viewed at any time via the Sens.ai App or by logging into your account at www.sens.ai/login.

6. WARRANTY
One-Year Limited Hardware Warranty – Sens.ai Headset. Sens.ai warrants that your Sens.ai Device and accessories are free from defects in materials or workmanship for one year. If applicable local law provides for a longer mandatory warranty period, that longer period will apply. This Warranty does not cover loss, misuse, wear and tear, damage from unauthorized use, or unauthorized modifications. Commercial use by a Professional Member in good standing is authorized and does not void this warranty. For full warranty details, refer to the Terms of Sale.

7. MEDICAL DISCLAIMER
Sens.ai provides tools for wellness, cognitive training, and performance optimization. Sens.ai Products and Services do not provide medical advice and are not a substitute for professional medical care. They are not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare provider before beginning or modifying any wellness or training program.

8. DATA PROTECTION
We process your data according to our Privacy Policy. By using the Services, you consent to such processing.

9. LIMITATION OF LIABILITY Sens.ai is not liable for any indirect, incidental, or consequential damages. Our liability is limited to the amount paid for the Product or Service.

10. TERMINATION We may suspend or terminate your Membership or access to Services if you violate these Terms.

11. GOVERNING LAW
These Terms are governed by the laws of British Columbia, Canada. Disputes will be resolved in the courts of British Columbia.

12. CHANGES TO TERMS
We may update these Terms from time to time. Continued use of the Products or Services after changes indicates your acceptance.
